The leak of the Alito draft wasn’t the only breach of the Supreme Court’s norms this term. Can Chief Justice Roberts curb its increasingly far-right leaning, or does the ghost of scalia'>Antonin Scalia loom too large in the nation’s highest court

Is this what other “originalists” believe? Scalia in 2011: “Certainly the Constitution does not require discrimination on the basis of sex. The only issue is whether it prohibits it. It doesn't. Nobody ever thought that that's what it meant.”

A bit more: Until 2003, Texas law made it illegal to engage in oral or anal intercourse with someone of the same sex. When the court found the law unconstitutional, Scalia dissented. He said 134 people had been prosecuted for adult consensual sodomy in the 50 prior years.

5 Justices agreed to overturn Roe. - (but take out, theoretically) 1 of those, Gorsuch, who filled Scalia's 2016 vacancy. Which was in the Obama presidency, but @LeaderMcConnell  refused a vote on his nominee. ------------------ Just 4 justices wld overturn Roe, not prevail.

Dear Editor: The Wisconsin State Journal had a letter from Herbert Lehner on interpreting the U.S. Constitution. He cites former Supreme Court Justice AntoninScalia that the words should mean today what they were understood to mean when they were…

From the President of Catholic University: “After she graduated from law school, I wrote a one-line letter of recommendation for her to scalia'>Justice Antonin Scalia: “Amy Coney is the best student I ever had.” He was wise to hire her as a clerk.”

Amy Coney Barrett opposed Merrick Garland’s nomination because: 1. It came the same year as a presidential election, and, 2. She said the nomination couldn’t go through because Scalia would be “replaced by someone who could dramatically flip the balance of the court.” Like her.

When Merrick Garland was nominated in 2016 to fill JusticeScalia’s seat, we were 237 days away from an election. Now we’re just 42 days away from an election, yet Leader McConnell wants to jam a nominee through. That’s a dangerous double standard that can’t be allowed to stand.

“It has been 80 years since a Supreme Court vacancy was nominated and confirmed in an election year. There is a long tradition that you don’t do this in an election year.” - Ted Cruz, 2016, following JusticeScalia’s death

If the Senate needed to wait nine months when scalia'>Justice Scalia died, then it surely needs to wait four months now. If the American people deserved to have their voices heard then, they deserve to have their voices heard now. #FollowTheMcConnellStandard
